Terms of Service

Effective date: June 16, 2026

Welcome to Project Huck. These Terms of Service (“Terms”) are a binding agreement between you and Project Huck (“Project Huck,” “we,” “us,” or “our”) governing your use of the Project Huck mobile app and related services (the “App”). Our Privacy Policy explains how we handle your data and is incorporated into these Terms.

Please read §9 (Assumption of Risk) and §10–11 (Disclaimers and Limitation of Liability) carefully — action sports are inherently dangerous and you ride at your own risk.

1. Acceptance of these Terms

By creating an account or using the App, you agree to these Terms and our Privacy Policy. If you don’t agree, don’t use the App.

2. Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian. By using the App you represent that you meet these requirements.

3. Your account

You’re responsible for your account, for keeping your password secure, and for activity that happens under your account. Provide accurate information (including your email and handle) and keep it current. Notify us at support@projecthuck.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. The service

Project Huck helps you track your progression in action sports — wakeboarding, surfing, kiteboarding, and winging — by logging sessions, building a trick “bag,” sharing clips, joining crews and challenges, and connecting with other riders. The App also offers trick suggestions, session plans, and progression analytics. These are informational tools to support your own riding decisions — not professional instruction, coaching, or a guarantee that any trick is safe for you to attempt (see §9). We may add, change, or remove features at any time.

5. Your content and the license you grant us

You own your content. Clips (videos), comments, tips, captions, session data, and anything else you create or upload (“Your Content”) remain yours. We don’t claim ownership of it.

The license you grant us. To operate and promote the App, you grant Project Huck a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (e.g. reformat, transcode, crop, or create thumbnails and previews), publish, publicly display, publicly perform, and distribute Your Content:

  • (a) To run the service — displaying Your Content to other users according to the visibility you choose (public, crew-only, or private), powering the feed, profiles, leaderboards, sharing graphics, and related features.
  • (b) To market and advertise Project Huck — featuring Your Content to promote the App, including in advertising, marketing, and promotional materials on Project Huck’s own channels and on third-party platforms and other apps (for example, running a clip you posted publicly as part of a Project Huck ad or social post). This is a license to promote Project Huck — we do not sell Your Content to third parties for their independent advertising.

This license covers only content you choose to make visible beyond yourself. Content you mark Private is not used for the marketing and advertising purposes in (b). Where reasonably practicable, we attribute featured content to your handle.

Scope and end of the license. The license in (a) ends a reasonable time after you delete Your Content or your account, except for content others have re-shared or that we must retain to comply with law. Marketing and promotional materials already produced or published under (b) before you deleted the content may continue to be used, but we won’t put your previously-public content into new advertising after you’ve deleted it or your account.

Your responsibility. Only post content you have the right to post. Don’t post content that infringes anyone’s intellectual property, privacy, or other rights, and make sure people who appear in your clips are okay with you posting them.

Feedback. If you send us ideas or suggestions, we may use them without obligation to you.

6. Acceptable use

You agree not to:

  • post content that is unlawful, harassing, hateful, threatening, defamatory, obscene, or sexually explicit, or that depicts dangerous activity presented to encourage others to recreate it unsafely;
  • infringe others’ intellectual property or post content you don’t have the rights to;
  • impersonate others, or misrepresent your affiliation or identity (including misuse of pro/brand account types);
  • spam, scrape, or use bots; interfere with or attempt to breach the App’s security; or reverse-engineer the App except as permitted by law;
  • harvest other users’ data or use the App to violate anyone’s privacy.

We may remove content or restrict accounts that violate these rules, and we may report unlawful activity to authorities.

7. Other users' content

Content posted by other users is their own. We don’t endorse it and aren’t responsible for it. Trick suggestions, tips, and progression advice — whether from us or other riders — are not professional instruction. Use your own judgment (see §9).

8. Huck+ subscriptions and purchases

Some features require Huck+, a paid subscription.

  • Billing. Subscriptions are sold and billed through the Apple App Store or Google Play, under their terms. Prices are shown in the App before purchase.
  • Auto-renewal. Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current period. Manage or cancel your subscription in your App Store / Google Play account settings — not in the App.
  • Free trials. If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
  • Refunds. Purchases are handled by Apple/Google and are subject to their refund policies; we generally can’t issue refunds directly.

9. Assumption of risk

Action sports — including wakeboarding, surfing, kiteboarding, and winging — are inherently dangerous and can result in serious injury or death. Project Huck provides information, suggestions, and tracking tools only. It does not coach you, supervise you, or assess whether any trick, spot, or condition is safe for you. You are solely responsible for evaluating your own ability, equipment, conditions, and surroundings, and for deciding what to attempt. Always ride within your limits, use appropriate safety equipment, follow local laws and rules, and seek qualified in-person instruction. By using the App, you assume all risks of your riding activities.

10. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranties about accuracy, reliability, conditions/weather data, trick or safety information, or uninterrupted availability. Some jurisdictions don’t allow certain disclaimers, so some of the above may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, Project Huck and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, or for any personal injury or death, arising from your use of the App or your riding activities. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the 12 months before the claim, or US $100. Some jurisdictions don’t allow these limits, so they may not fully apply to you.

12. Indemnification

You agree to indemnify and hold Project Huck harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the App, or your violation of these Terms or others’ rights.

13. Termination

You may stop using the App and delete your account at any time (in the App or by contacting support@projecthuck.com). We may suspend or terminate your access if you violate these Terms or to protect the App and its users. Sections that by their nature should survive (including §5 content-license tail, §9–12, and §14) survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-laws rules. You and Project Huck agree to the exclusive jurisdiction of the state and federal courts located in Boston, Massachusetts for any dispute not subject to other agreed dispute-resolution terms. (If we add binding arbitration or a class-action waiver, we’ll present it clearly and separately.)

15. Changes to these Terms

We may update these Terms from time to time. When we do, we’ll revise the “Effective date” above and, for material changes, provide a more prominent notice in the App. Continued use after changes take effect means you accept the updated Terms.
